Professor Rafael Cox Alomar will* Explain the latest trends on how sovereign states compete for direct foreign investment (particularly in energy, mining, infrastructure) by entering into bilateral investment treaties that protect the investments made by the nationals of the contracting parties in each other’s territory from illegal (physical and regulatory) expropriations, inequitable treatment, and other violations of public international law.
* Discuss how bilateral investment treaties provide for international arbitration as the dispute settlement mechanism for adjudicating those claims raised by foreign investors against sovereign states, thus bypassing domestic (public) courts.
*Share some of his insight as former co-counsel for various Latin American sovereigns in investor state arbitrations administered by the International Centre for the Settlement of Investment Disputes (ICSID) of the World Bank.
* Highlight some of the legal and policy challenges that could arise in Transition Minerals Ltd vs. Government of Greenland and Government of Denmark - concerned with uranium mining rights in Greenland.
